Terms of Use
The rules for ordering a cake through CakeBabu, and for bakeries that sell through it. By sending an order, or by logging in as a bakery, you agree to them.
In short
- CakeBabu is a platform. The bakery makes and sells your cake. We connect you and give you the tools.
- You pay the bakery directly by UPI after it accepts your order. We never hold your money.
- Handmade cakes can differ a little from the 3D preview.
- Have an allergy? Write it in the order note and call the bakery.
- Problem with an order? Talk to the bakery first, then write to us. We will help.
This summary is a help, not the whole picture. The full text below is what applies.
1About CakeBabu
CakeBabu (“the Service”) is a website, and any apps we release, run by Anubhav Kalita from Guwahati, Assam, India (“we”, “us”). It lets you design a cake in 3D, choose a local bakery and send it your order.
CakeBabu is an online platform, not a bakery. The cakes are made, sold and delivered by independent bakeries. Your contract for the cake is with the bakery. We provide the platform and the order tools, and we help sort out problems.
2Using CakeBabu
- You must be 18 or older, or use CakeBabu with a parent or guardian.
- Give your real name, a mobile number that is yours (or whose owner agreed), and a correct address.
- We check your mobile number with an SMS code before an order can be sent.
- An account is optional. You can sign in with your mobile number, an email address or Google. Anyone who can read your SMS or email, or use your Google account, can sign in as you, so keep those safe, and sign out on shared devices.
- You can delete your account any time from the profile button. See our Privacy Policy for what is deleted.
Please do not place fake or prank orders, try to break or overload CakeBabu, get around its limits (such as the limit on SMS codes), collect other people’s details, or use it for anything illegal. If someone does, we can block their access.
3Designing your cake
The 3D cake is a guide. Cakes are made by hand, so colours, piping, decorations and shape can differ a little from the preview, and screens show colours differently.
Before you send an order, CakeBabu tells you if a bakery cannot make something exactly as designed. A bakery can still accept or decline any order. An order is confirmed only after the bakery accepts it and your payment is confirmed. Check the spelling of any message you type on the cake, because the bakery writes what you typed.
4Orders and prices
This is how an order goes:
- You send your order to the bakery. Nothing is charged.
- The bakery accepts it, or declines it and tells you why.
- If it accepts, you pay the bakery by UPI.
- The bakery confirms your payment, then bakes, decorates and hands the cake over by delivery or pickup.
Each bakery sets its own prices. The total, including any delivery fee, is shown before you send the order. If a bakery changes its prices while you are designing, we show you the new total first. The price of an accepted order does not change.
5Delivery and self pickup
Each bakery chooses to deliver within a distance, or to offer self pickup only. If you are outside a bakery’s delivery distance, self pickup is the option.
- Distance is approximate. It is measured in a straight line from the location you share to the bakery. The road distance is longer. If you type an address instead of sharing your location, we cannot measure it, and the bakery may ask you to pick up instead.
- Delivery time is a window, not an exact time. Bakeries try to keep to it, but traffic and weather can cause delays.
- Be reachable. Give a full address and a number that will be answered, and have someone there to receive the cake. If the bakery cannot reach you or deliver because of wrong details, it may charge for a second trip, or may be unable to refund a cake that was already made.
- Self pickup. You get the bakery’s address once it accepts your order. Collect the cake in the slot you chose, and check it before you leave.
6Paying
All orders are paid online. There is no cash on delivery.
- You pay the bakery directly by UPI, after it accepts your order. You scan its QR code or open your UPI app from a link. The amount is fixed.
- CakeBabu does not receive, hold or process your money, and is not a payment service.
- After you pay, tap “I’ve paid”. You can add the UPI reference number. The bakery checks its own UPI app and confirms. Until it does, baking does not start. If the bakery says it has not received the money, you can pay again or contact it.
- Keep your payment screenshot or reference number until the cake arrives.
- If money leaves your account but the bakery does not get it, your bank and UPI app handle that, under their own rules. We can help by showing the order details.
- Some UPI apps block payment links to certain UPI IDs. If that happens, scan the QR code instead.
If we add another way to pay, such as a payment gateway, we will update these terms first.
7Cancelling and refunds
- Before the bakery accepts, or before you pay: you can cancel in CakeBabu, free of charge.
- After you have told us you paid: the order cannot be cancelled in CakeBabu. Contact the bakery, or write to us.
- Once baking has started: because each cake is made specially for you, the bakery may refuse to cancel just because you changed your mind.
You should get a refund from the bakery if it declines or cancels an order you have paid for, the cake is not delivered or not ready, the cake does not match your accepted order (wrong flavour, size or message, say), the cake is spoiled or unsafe, or it arrives much later than the slot for a reason the bakery could have avoided. The refund goes back to the account you paid from, usually by UPI. The bakery is responsible for it, because it received the money.
Tell the bakery, and us, as soon as you notice a problem, ideally the same day and with a photo. If the bakery does not treat you fairly, write to us. We will contact it, and we can remove a bakery from CakeBabu. We do not hold your money, so we cannot pay refunds ourselves.
Your rights under the Consumer Protection Act, 2019 and other laws are not affected by this section.
8Food, allergies and safety
Bakeries are independent food businesses. They must follow food safety law, including FSSAI registration or licence and hygiene rules.
Cakes can contain, or be made near, eggs, milk, gluten, nuts, soy and other allergens. If you or the person eating the cake has an allergy, write it in the note and call the bakery before you order. CakeBabu cannot promise that any cake is free of an allergen. Eat the cake soon and store it the way the bakery tells you.
9If you’re a bakery
A bakery that sells through CakeBabu follows these terms too. By logging in to the bakery dashboard, you agree to this section.
- You are an independent seller. You set your menu, prices, delivery distance and the orders you accept. You are responsible for the cakes you sell.
- Licences. You must hold the licences you need, such as FSSAI registration or licence, and any local permission. You give us the details we ask for, such as your FSSAI number, business name and address, and keep them up to date. We may show them to customers.
- Be accurate. Keep your menu, prices and delivery distance correct. Accept only orders you can make as designed and in time. If you cannot, decline quickly and give a reason.
- Payments. Enter your own UPI ID. Tap “Payment received” only when the money is in your account, and do not start baking before that. Payments sent to the UPI ID you entered are your responsibility.
- Quality and care. Hygiene, ingredients and allergen information, delivery or handover, refunds (see “Cancelling and refunds”) and complaints are yours to handle.
- Customer details. Use customers’ names, numbers and addresses only to complete their order and sort out problems. Keep them safe, including printed order sheets. Do not share or sell them, do not message customers for marketing, and delete them when you no longer need them.
- Your PIN is secret. You are responsible for what is done with it. If it is lost, ask us and we will set a new one.
- Fees. CakeBabu does not charge a fee at the moment. If we introduce one, we will tell you in advance, and you can choose to leave.
- Removal. We may pause or remove a bakery that breaks these terms, gets repeated complaints, or puts customers at risk.
10Our content and your designs
CakeBabu’s software, name, look and sample designs belong to us. You may use CakeBabu for its purpose, but you may not copy it or sell it on.
The cake designs you make are yours. When you send an order, you let the bakery use your design and its picture to make your cake. Do not type messages for a cake that are unlawful or hateful. The bakery can decline them.
11Our responsibility
We work to keep CakeBabu running and accurate, but it is provided as it is. It can be slow or down at times, and an order sent while it is down may not reach the bakery. We show you an error when that happens.
We are not the baker, seller or deliverer. As far as the law allows, we are not responsible for a bakery’s cake, prices, delivery or refunds, or for payments between you and a bakery, or made through UPI apps and banks. We are not liable for indirect losses, such as a missed party. Where the law allows, our total liability to you for anything connected with CakeBabu is limited to the amount you paid for the order concerned.
Nothing here takes away rights you have under any law that cannot be excluded, including the Consumer Protection Act, 2019.
12Changes, ending and the law
We may update these terms. We change the date at the top when we do, and we tell you in CakeBabu about big changes. If you keep using CakeBabu after a change, you accept it. You can stop using CakeBabu, and delete your account, any time. We can suspend access, or close an account, if these terms are broken.
These terms are governed by Indian law. Courts in Guwahati, Assam, can hear disputes about them. This does not limit your right to go to the consumer commission where you live or work. Please talk to us first. Most problems are solved quickly that way.
